Terms of Service

These Terms of Service (“Terms”) govern your use of the Gymilit application (“the app”). By creating an account, you agree to these Terms.

1. Not Medical Advice

Gymilit does not provide medical advice. The app is a workout tracking and program generation tool. AI-generated workout programs are created using general exercise science principles and are not a substitute for professional guidance.

  • Consult a healthcare professional before starting any exercise program, especially if you have injuries, medical conditions, or physical limitations.
  • The injury and contraindication features in the app are informational only. They help the AI avoid exercises that are generally inadvisable for certain conditions, but they do not replace a clinical assessment.
  • You are solely responsible for determining whether any exercise is appropriate for you.

2. Account

  • You must provide a valid email address to create an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must be at least 16 years old to use Gymilit.

3. Subscription and Pricing

  • Free tier: Full workout tracking and one AI-generated program (lifetime limit).
  • Pro tier: $4.99/month or $29.99/year. Unlimited AI program generation and all features.
  • Subscriptions are billed through Apple App Store or Google Play. Cancellation and refund policies are governed by the respective platform.
  • We reserve the right to change pricing with reasonable notice. Existing subscriptions continue at their current rate until the next renewal cycle after the change takes effect.

4. Acceptable Use

You agree not to:

  • Use the app to create, store, or share content that is harmful, abusive, or illegal.
  • Attempt to access other users' data or bypass security measures.
  • Use automated tools to access the app or its APIs beyond normal usage.
  • Share programs containing harmful exercise instructions or misleading health claims.
  • Reverse engineer, decompile, or extract source code from the app.

5. Content Ownership

  • Your data: You own all workout data, programs, and content you create in Gymilit. We do not claim ownership of your data.
  • AI-generated programs: Programs generated by the AI feature are licensed to you for personal use. You may share them through the app's sharing feature.
  • Shared programs: When you share a program, other users can view and import it. You retain ownership of the original program.
  • App content: The Gymilit app, its design, exercise database, and AI systems are our intellectual property.

6. Account Termination

  • You may delete your account at any time from the Profile screen. Account deletion permanently removes all your data.
  • We may suspend or terminate your account if you violate these Terms or engage in abuse of the platform.
  • On termination, you may export your data before deletion (Profile > Export My Data).

7. Limitation of Liability

To the maximum extent permitted by law:

  • Gymilit is provided “as is” without warranties of any kind, express or implied.
  • We are not liable for any injuries, health issues, or damages that result from following workout programs created by the app or its AI features.
  • We are not liable for data loss, though we take reasonable measures to protect your data (encryption, backups, row-level security).
  • Our total liability for any claim related to the app is limited to the amount you have paid us in the 12 months preceding the claim.

8. Shared Program Guidelines

Programs shared through the app must not:

  • Contain harmful or dangerous exercise instructions
  • Include misleading health or fitness claims
  • Contain offensive, discriminatory, or inappropriate content in program names, descriptions, or notes

We reserve the right to remove shared programs that violate these guidelines.

9. Service Availability

  • We aim to keep Gymilit available and reliable, but do not guarantee uninterrupted access.
  • The app functions offline for workout tracking and program viewing. AI generation and data sync require an internet connection.
  • We may perform maintenance that temporarily affects availability, with advance notice when possible.

10. Changes to These Terms

We may update these Terms to reflect changes in the app or legal requirements. If we make material changes, we will notify you through the app or via email. Continued use of the app after changes take effect constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict of law principles. Any disputes will be resolved in the courts of Ontario.
